Position Summary:
We have an exciting opportunity to join our team as a Associate General Counsel - Litigation Management & Malpractice.

In this role, the successful candidate Under the direction of the Associate General Counsel Director of Litigation Management Malpractice; and the VP Senior Counsel for Malpractice Insurance Administration the primary responsibility of this role is to provide competent timely and proactive legal advice in the daily handling and management of medical malpractice cases and claims which are insured under the NYU Langone Hospitals Malpractice Insurance Program The primary client is the CFO/Sr Vice President This role will directly manage and direct the day to day activities of the assigned claim files and outside counsel by proactively coordinating the most reasonable and strategic defenses to optimize claim handling and results There is a heavy emphasis on the successful direct management and negotiation of litigated and pre litigation claims with a successful case closure target number

Job Responsibilities:

Under the direction of the Associate General Counsel, Director of Litigation Management, Malpractice; and the VP & Senior Counsel for Malpractice Insurance Administration, the primary responsibility of this role is to provide competent, timely and proactive legal advice in the daily handling and management of medical malpractice cases and claims, which are insured under the NYU Langone Hospitals Malpractice Insurance Program.  The primary client is the CFO/Sr. Vice President.  This role will directly manage and direct the day-to-day activities of the assigned claim files and outside counsel by proactively coordinating the most reasonable and strategic defenses to optimize claim handling and results.  There is a heavy emphasis on the successful direct management and negotiation of litigated and pre-litigation claims with a successful case closure target number.

 

    • Assume primary responsibility for the legal management and resolution of approximately 100 high value claims assigned in various state and federal jurisdictions
    • Assist in choice of counsel
    • Proactively manage and direct outside defense counsel
    • Actively manage litigation costs and expenses
    • Keep the Associate General Counsel Director of Litigation Management Malpractice and Vice President amp; Senior Counsel of the Malpractice Insurance Program informed of material changes and updates in the status of litigation
    • Initiate early strategic resolution of claims where possible
    • Actively negotiate cases directly with adversaries
    • Stay up to date on changes in law and legal climate
    • Provide legal analysis and positions on coverage issues
    • Provide day to day strategic planning on claims handling
    • Provide timely responses to time sensitive projects as assigned
    • Attend and travel to all phases of Court conferences on each case as needed
    • Manage attend and direct as necessary preparation of key defendants for depositions and trial
    • Monitor all phases of trial timely reporting of daily progress and modify strategies as developments dictate
    • Participate and present in claims conferences; lead roundtable discussions and committee reviews; present case summaries as needed
    • Prepare Executive Claims Summary for each case being handled with timely reserve setting recommendations
    • Keep claims professionals up to date on emerging legal issues nbsp;
    • Review and manage pleadings motions briefs appellate papers etc as needed to proactively defend and strategically manage litigation
    • Perform other related duties as assigned

Minimum Qualifications:
To qualify you must have a Admission to the NYS Bar with at least 12 years experience in broad based medical malpractice which must include experience in insurance law coverage issues and disputes and NY litigation Significant direct negotiation skills and aptitude Proven management experience at partner level and claims experience preferred Effective oral and written communication skills with the ability to present case reviews and recommendations work collegially with diverse personnel and under the direction of the Associate General Counsel Director of Litigation Management Malpractice Maintain NYS bar admission in good standing for the duration of the position

Preferred Qualifications:
Proven management experience at partner level and claims experience preferred

NYU Langone Health provides a salary range to comply with the New York state Law on Salary Transparency in Job Advertisements. The salary range for the role is $213,477.55 - $250,000.00 Annually. Actual salaries depend on a variety of factors, including experience, specialty, education, and hospital need. The salary range or contractual rate listed does not include bonuses/incentive, differential pay or other forms of compensation or benefits.
