Job Summary:

Grade: NF05, Salary Code 5A.

Acts as the Senior Facilities Contracts Specialist performing all duties related to the planning, development, advertisement, award, administration, and closeout of construction, facilities, and architect/engineer contracts, aligning with NEXCOM requirements.

Duties and Responsibilities:

- Contractual Authority: Exercises contractual authority, within authorized limits, to enter into contracts using non-appropriated funds for the NAFI.

- Solicitation Package Development: Develops and assembles request for quotation (RFQ) and request for proposal (RFP) solicitation packages, ensuring they align with relevant policies and are appropriately formatted for different contracting methods (e.g., sealed bid, negotiated, simplified acquisitions). These packages support NEXCOM facility construction, repair, renovation, sustainment, architectural, engineering, professional services, and field requirements. Prepares contracts and contract specifications for development, demonstration models, and preliminary designs involving new or untried concepts or techniques.

- Negotiation Strategy: Plans both pre and post-negotiation strategies, coordinates with stakeholders, and leads negotiations to determine contract price and terms. Directs or performs post-award negotiations, including contract changes or modifications, unsettled change proposals, special agreements, and pricing arrangements. Negotiates changes in price, terms, and conditions, overhead rate agreements due to contract modifications, supplementary agreements, settlements from change orders due to defective specifications, and/or changed site conditions. Prepares comprehensive documentation related to negotiation and pricing actions.

- Contract Budget Monitoring: Oversees contract budgets and other contract-related administrative actions to ensure financial accountability. Reviews contractor submittals and certifies completed work for scheduled progress payments. Compiles audit-ready contract files and reviews completed official contract files to ensure all contractual requirements are met, no pending administrative actions remain, all documents are properly signed, no litigation actions are pending, and the contract is complete in every respect. Certifies that the contract is ready for final payment and closure.

- Cradle-to-Grave Support: Provides comprehensive cradle-to-grave contracting support, starting with the review of procurement requests for clarity, adequacy, and completeness. Obtains all necessary pre-solicitation clearances, develops and recommends the most suitable type of contract and incentive structure for use by the contracting officer, handles solicitation efforts, develops vendor base, coordinate preconstruction efforts including contracting officer's representative (COR) integration, and executes contract awards, task orders, and/or modifications/contract options. Monitors contractor technical performance over the contract's lifespan and coordinates post-performance assessments and warranty follow-up as required.

- Source Selection Authority: Serves as the Source Selection Authority and/or Source Selection Board member to evaluate contractor past performance, price, experience, and technical ability. Utilizes pricing trends, economic factors, and historical statistical cost data to analyze the contractor's costs, pricing, and financial capability to perform the contract's requirements.

- Stakeholder Collaboration: Collaborates with internal and external stakeholders such as project managers, engineers, architects, and legal counsel to ensure effective communication, coordination, and resolution of contract-related issues.

- Contract Compliance: Issues cure and/or show-cause notices when the contractor is not in compliance with contract provisions and/or specifications. Terminates contracts for default and/or convenience if required. Manages contractor requests for equitable adjustments and adjudication of contractor claims. Develops documents for legal review as required.

- Senior Level Review: Provides senior-level review of junior contract specialist actions.

- Policy Enforcement and Improvements: Supports and upholds NEXCOM contracting policies and procedures. Makes recommendations for and implements process improvements as required. Provides advice, training, mentoring, guidance, and interpretation to junior level contracting personnel on procurement regulations, policies, and procedures.

- Performs other related duties as assigned.

Note: The incumbent of this position must file a Financial Disclosure Report (OGE) Form 450, as required.

Requirements

EXPERIENCE CONSISTING OF THE FOLLOWING:

EDUCATION: a 4-year Baccalaureate degree in any field.

OR

24 semester hours of bachelor degree level classes in any of the following fields: accounting, business, finance, law, contracts, purchasing, economics, industrial management, marketing, quantitative methods, or organization and management.

AND SPECIALIZED EXPERIENCE: Four years of progressive contracting experience, (government or private sector) with a focus in construction that allowed the candidate to demonstrate the ability to execute a majority of the following: Develop and implement prototype solicitation package for unique system wide and or regional contracts, requiring innovative, specialized and nonstandard acquisition methodology; Independently prepare and issue a request for proposals; Demonstrate knowledge and/or conduct negotiations with offerors, including independent preparation of appropriate correspondence; Demonstrate knowledge of competitive range determinations, including how to determine offerors to exclude and including competitive ranges; Independently evaluate proposals, and prepare contract action clearance documentation or contract review board memorandums. Present cases to the contract review board to award large purchase; debrief unsuccessful offerors and/or independently prepare appropriate documentation to provide debriefing information to unsuccessful offerors.

The Navy Exchange Service Command (NEXCOM) is the headquarters for the worldwide NEXCOM Enterprise and is one of 11 commands under the Commander, Naval Supply Systems Command (NAVSUP).

NEXCOM offers exciting opportunities to join a unique provider of goods and services to Navy Sailors and their families around the world.  We are a $2+B enterprise, operating over 300 Navy Exchange retail locations and 100 Navy Hospitality locations around the US and in 13 foreign countries, on nearly 100 Naval Bases globally.  Our NEX oversees the operation and management of retail stores, food services, hotels, auto shops, and other services.

NEXCOM oversees six primary business programs:

  • Navy Exchange (NEX) Retail Stores and Services
  • NEXCOM Hospitality Group
  • Uniform Program Management Office (UPMO)
  • Navy Clothing Textile and Research Facility (NCTRF)
  • Ships Stores Program
  • Telecommunications Program Office (TPO)

With the exception of the Ships Store Program, the NEXCOM Enterprise conducts its operations as a federal non-appropriated funded instrumentality. As such, the command is self-supporting with 70 percent of its profits given to Navy Morale, Welfare and Recreation (MWR) programs and the remaining 30 percent reinvested in NEX buildings and equipment.

NEXCOM is a military organization and is subject to congressional legislation as well as oversight from the Department of the Navy. NEXCOM’s parent command is the Naval Supply Systems Command (NAVSUP).
